1.- LUGAR Y FECHA DE LOS EVENTOS O SESIONES.-

Se deberá especificar el lugar o los lugares de la(s) sesio(nes) o evento(s) a cubrir. La FOTÓGRAFA deberá llegar por lo menos 15 minutos antes de la hora acordada. El CLIENTE puede llegar a la hora acordada. Si el CLIENTE llega más tarde de la hora acordada se recortará el tiempo de sesión los minutos u horas que llegue tarde. 





1.1.- LOS PERMISOS DE LUGAR, UBICACIONES O MATERIALES REQUERIDOS EN LA UBICACIÓN.-
El CLIENTE suministrará a LA FOTÓGRAFA los productos, la autorización de ingreso y permisos a los lugares a fotografiar, así como todo el material necesario para la correcta elaboración de la sesión y/o evento, y deberá garantizar la veracidad y exactitud de ella, siendo responsabilidad del CLIENTE los errores que pudieren contener o suceder. El CLIENTE tiene la responsabilidad de dar las ubicaciones exactas de los lugares donde se fotografiar por lo menos 2 semanas antes del evento o sesión.
 

1.2.-VIÁTICOS.-
EL CLIENTE Se responsabiliza por los viáticos si es que los fotógrafos se tienen que quedar en un hotel pues el evento termina tarde. También si el evento o sesión es fuera de Pachuca, Hidalgo, se generan viáticos de traslado. El CLIENTE se hace responsable de todas las entradas que se requieran para acceder a los lugares de la sesión o evento, valet parking, entre otros



3.- PÁGOS.-
El evento se aparta con el 30% para asegurar la fecha y se liquida en su totalidad una semana antes del evento o antes para que LA FOTÓGRAFA pueda asistir. Si es sesión se aparta con el 50% y el resto se liquida el día de la sesión. 
 

3.1- LOS ABONOS NO SON REEMBOLSABLES.

Si por alguna razón el cliente desea cancelar la adquisición de algún producto y/o servicio, no se realizará la devolución en ningún tipo, ni porcentaje del monto parcial o total que haya dado con anterioridad. El monto será retenido por gastos de logística, penalización por cancelación y preparativos previos. El cliente al firmar y/o realizar un anticipo parcial o total, está aceptando cada una de las políticas, reglamentaciones y condiciones estipuladas en este contrato. 

 

4.- INTERRUPCIÓN DE FAMILIARES Y/O OTROS FOTÓGRAFOS AGENOS AL EQUIPO DE JRP-
LA FOTÓGRAFA no se hace responsable de algún momento que no se haya podido captar por la interrupción de familiares y/o otros fotógrafos o videógrafos que se interponen en la toma para ellos tomar fotografías con sus cámaras, celulares o tablets. Debido a los problemas y molestias que presenta el trabajar dos videógrafos o fotógrafos en un mismo lugar, al pelear el “mejor lugar o ángulo” en cada toma, es responsabilidad del cliente informar a terceros colegas el no interferir en nuestro trabajo, de lo contrario no se realizaran tomas del momento, y por ende NO habrá material fotográfico o de video de esta sección del evento, y tampoco se realizaran reembolsos por información faltante. El cliente está consciente que el equipo de Julia Rivera Photography tiene la preferencia y exclusividad total de la cobertura del evento. 

 

5.- PLAZO DE ENTREGA.-
5.1.- ENTREGAS EN EVENTOS.- LA FOTÓGRAFA se obliga para con el CLIENTE a entregar el trabajo digital del presente contrato en un plazo de sesenta días (60) días hábiles después del evento, sin contar sábados y domingos, si es que hay también sesión posterior al evento sería la entrega después de la última sesión. Después del que el cliente eligió las fotos a imprimir y aprobó el photobook las impresiones tardan en llegar días (30) días hábiles después de su elección. 


5.2.- ENTREGAS EN SESIONES.- LA FOTÓGRAFA se obliga para con el CLIENTE a entregar el trabajo digital del presente contrato en un plazo de treinta (30) días hábiles después de la sesión, sin contar sábados y domingos, y después del que el cliente eligió las fotos a imprimir y aprobó photobook, si es el caso, las impresiones tardan en llegar días (30) días hábiles después de su elección.

6.- SOBRE EL MATERIAL.-

EL CLIENTE deberá escoger las fotos que serán editadas y/o ampliadas dentro de un plazo máximo de quince (15) días contados desde la fecha en que LA FOTÓGRAFA le hubiese proporcionado el material a escoger. El material digital será conservado por LA FOTÓGRAFA por dos (2) meses, pasado este periodo el material será borrado. Sobre el material impreso CLIENTE tiene 15 días, después de ser notificado, para la recolección del material impreso en Perfumería Julië de Pachuca Centro. Si no lo recoge dentro de un mes, este será eliminado, si es que los clientes viven fuera de la ciudad y no lo pueden recoger se les hace el envío del material a su domicilio con el cargo extra de la paquetería.

7.- DERECHOS RESERVADOS.-

LA FOTÓGRAFA se reserva el derecho de impresión y el uso en medios visuales, internet, de cualquier fotografía solo para su uso personal y de promoción. Toda imagen o video captado por cualquiera de los miembros del personal o equipo fotográfico y de video, es de propiedad del estudio fotográfico, así como del fotógrafo o videógrafo que realizo la toma, por lo cual los derechos de imagen son exclusivos del estudio fotográfico. 
El cliente que contrato el servicio y/o productos, obtiene copias digitales o impresas de estas imágenes o servicios como parte de sus derechos adquiridos en el contrato, sin embargo, las imágenes originales quedan a disposición de Julia Rivera Photography decidiendo cuales desea conservar y cuales eliminar de la base de datos. Dichas imágenes y videos podrán ser utilizados con fines publicitarios, elaboración de artículos muestra (álbumes, cuadros, book, etc), publicación y exhibición de sitios Web y redes sociales, así como uso comercial con fines lucrativos siendo los ingresos monetarios del mismo, exclusivamente de Julia Rivera Photography y personal interno del mismo. De la misma manera, todo el material que se suministre para su publicación, libera a LA FOTÓGRAFA de cualquier riesgo por el uso indebido de material que sea propiedad de un tercer, como escritos, logos, marcas o sitios prohibidos a fotografiar etc, que le suministre, así como demandas por el uso de material no propio.

8.- PROPIEDAD INTELECTUAL.-

LA FOTÓGRAFA mantiene la titularidad y propiedad legal de todas las imágenes entregadas al cliente y son solo para el uso personal del CLIENTE. Cualquier uso diferente del personal, como publicitario, debe ser consultado previamente con LA FOTÓGRAFA para su aprobación. 

 

8.- RESPONSABILIDAD.-

LA FOTÓGRAFA se exonera de cualquier responsabilidad en caso de pérdida del material de la sesión por fallas técnicas ajenas a su voluntad. En este evento se llevará a cabo nuevamente la sesión sin costo alguno o reembolso del monto del evento en su totalidad.

9.- ASISTENCIA.-

En caso de que el equipo de fotografía no asista al evento se reembolsará el monto pagado al 100% (CIEN POR CIENTO). Al menos que el cliente no hubiera dado con exactitud las ubicaciones y direcciones del evento. Ahí no se hace el reembolso de ninguna manera.

10.-CANCELACIONES.-

EL CLIENTE Si por algún motivo el evento (Cualquier tipo) es suspendido por causas de la Iglesia, problemas administrativos, tiroteos, objeciones de matrimonio (si es que aplica), problemas entre familiares e invitados, accidentes, lesiones, incendios, asaltos, robos o cualquier acto externo que causara en algún punto la suspensión del evento, LA FOTÓGRAFA no realizaría devolución de ningún tipo.

En caso de cancelación del evento por factores externos como pueden ser incendios, catástrofes climáticas, manifestaciones, cierres, contingencias epidemiológicas, contingencias gubernamentales, toques de queda, cuarentenas, pandemias, perdidas familiares, o cualquier otro factor, motivo o circunstancia que afecte directa o indirectamente la realización del evento, NO existe la posibilidad de reembolso de los servicios contratados por motivos logísticos previos, pero podrá ser reagendado.

El evento puede ser reagendado a otra fecha disponible en calendario, siempre y cuando la fecha esté disponible y no se traslape junto con otro evento que ya tenga asignado y notifiquen por lo menos 8 días hábiles a LA FOTÓGRAFA.

​

En caso de re-agendar el evento para fechas posteriores, es obligación del cliente verificar que no se empalme su nueva fecha con algún evento ya asignado, de lo contrario no se podrá realizar la cobertura del evento y tampoco se procederá a realizar algún reembolso de ningún tipo por la cancelación del evento. En caso de que el evento sea re-agendado, la fecha para el pago total del servicio NO se re-agendara y deberá ser cubierto en su totalidad de acuerdo al programado de la fecha previamente.

11.- LÁSER DEL EQUIPO DE AUDIO E ILUMINACIÓN.- No se grabará o tomarán fotografías mientras haya láser del equipo de sonido o iluminación del evento, pues estos dañan las cámaras de por vida. 


 

Terms and Conditions

1. Event or Session Date, Time, and Location

The location(s) of the session(s) or event(s) to be covered must be specified in advance.

The PHOTOGRAPHER shall arrive at least 15 minutes before the scheduled start time. The CLIENT may arrive at the agreed time. If the CLIENT arrives late, the session time will be reduced by the amount of time the CLIENT is late.
 

1.1 Location Access, Permits, and Required Materials

The CLIENT shall provide the PHOTOGRAPHER with access authorization, entrance permits, products to be photographed, and any materials necessary for the proper execution of the session and/or event.

The CLIENT is responsible for ensuring that all information provided is accurate and complete and shall be liable for any errors or omissions.

The CLIENT must provide the exact locations where photography will take place at least two (2) weeks before the event or session.
 

1.2 Travel Expenses

The CLIENT is responsible for all travel-related expenses whenever applicable.

If the photographers are required to stay overnight because the event ends late, the CLIENT shall cover hotel accommodations.

If the event or session takes place outside Pachuca, Hidalgo, transportation expenses will apply.

The CLIENT is also responsible for covering any admission fees, valet parking charges, permits, or other expenses required to access the event or session locations.
 

2. Payments

For events, a 30% non-refundable retainer is required to reserve the date. The remaining balance must be paid in full one week prior to the event in order for the PHOTOGRAPHER to provide services.

For photography sessions, a 50% non-refundable retainer is required to reserve the date. The remaining balance is due on the day of the session.
 

2.1 Retainers Are Non-Refundable

If, for any reason, the CLIENT decides to cancel any product or service, no refund shall be issued for any partial or full payment previously made.

Payments will be retained to cover logistics, cancellation fees, and preparation costs.

By signing this agreement and/or making any payment, whether partial or full, the CLIENT acknowledges and agrees to all terms, policies, and conditions contained herein.
 

3. Interference by Family Members or Third-Party Photographers/Videographers

The PHOTOGRAPHER shall not be held responsible for any missed photographs or moments due to interference by family members or third-party photographers or videographers using cameras, mobile phones, tablets, or other devices.

Because multiple photographers or videographers competing for the best angle may interfere with coverage, it is the CLIENT'S responsibility to ensure that third parties do not obstruct the PHOTOGRAPHER'S work.

If interference prevents coverage of any portion of the event, no photographs or videos of that portion will be provided, and no refunds will be issued.

The CLIENT acknowledges that Julia Rivera Photography has exclusive priority regarding photographic coverage of the event.

4. Delivery Time

4.1 Event Deliveries

The PHOTOGRAPHER agrees to deliver the digital images within sixty (60) business days after the event, excluding Saturdays and Sundays.

If the contract includes a post-event session, delivery will occur after the final session.

Printed products will be delivered approximately thirty (30) business days after the CLIENT has selected the images for printing and approved the photo book design.
 

4.2 Session Deliveries

The PHOTOGRAPHER agrees to deliver the digital images within thirty (30) business days after the session, excluding Saturdays and Sundays.

Printed products, when applicable, will be delivered approximately thirty (30) business days after image selection and photo book approval.
 

5. Image Selection and File Retention

The CLIENT must select the photographs to be edited and/or printed within fifteen (15) days after receiving the gallery.

Digital files will be stored by the PHOTOGRAPHER for two (2) months. After this period, the files may be permanently deleted.

Printed products must be picked up within 15 days after notification at Perfumería Julië, located in downtown Pachuca.

If printed products are not collected within one month, they may be discarded.

Clients living outside the city may request shipping. Shipping costs are the CLIENT'S responsibility.
 

6. Copyright

The PHOTOGRAPHER reserves all rights to print, publish, display, and use photographs or videos for portfolio, promotional, advertising, website, social media, and marketing purposes.

All photographs and videos captured by any member of the photography or video team remain the exclusive property of the photography studio and the photographer or videographer who created them.

The CLIENT receives digital and/or printed copies as provided under this agreement; however, all original files remain the property of Julia Rivera Photography, which reserves the right to retain or delete any original files from its archives.

The PHOTOGRAPHER may use photographs and videos for promotional materials, sample albums, framed displays, portfolios, websites, social media, exhibitions, and commercial purposes.

The CLIENT also releases the PHOTOGRAPHER from liability arising from any copyrighted material, trademarks, logos, written content, or restricted locations provided by the CLIENT.
 

7. Intellectual Property

The PHOTOGRAPHER retains full legal ownership and copyright of all photographs delivered to the CLIENT.

The images are licensed exclusively for the CLIENT'S personal use.

Any commercial, promotional, advertising, editorial, or other non-personal use requires the PHOTOGRAPHER'S prior written authorization.
 

8. Liability

The PHOTOGRAPHER shall not be liable for loss of photographic material due to technical failures beyond the PHOTOGRAPHER'S reasonable control.

In such circumstances, the PHOTOGRAPHER may either:

• provide a new photography session at no additional cost, or

• refund the total amount paid for the affected event.
   

9. Attendance

If the photography team fails to attend the event, the CLIENT shall receive a 100% refund of all amounts paid.

However, no refund shall be issued if the CLIENT failed to provide accurate event locations or directions, resulting in the PHOTOGRAPHER'S inability to attend.
 

10. Cancellations and Rescheduling

If the event is suspended due to circumstances such as church decisions, administrative issues, wedding objections (where applicable), family disputes, guest conflicts, accidents, injuries, fires, assaults, theft, or any other external event causing cancellation, the PHOTOGRAPHER shall not issue any refund.

If the event cannot take place due to wildfires, natural disasters, severe weather, demonstrations, government restrictions, epidemics, pandemics, quarantines, curfews, family bereavement, or any other circumstance beyond either party's control, no refunds will be issued due to prior logistical preparations.

However, the event may be rescheduled.

Rescheduling is subject to the PHOTOGRAPHER'S availability and must be requested at least eight (8) business days in advance.

The CLIENT is responsible for ensuring that the requested new date does not conflict with another event already booked by the PHOTOGRAPHER.

If the requested date is unavailable, the PHOTOGRAPHER shall have no obligation to provide services on that date, and no refund will be issued.

Rescheduling the event does not change the original payment schedule. All payments must be made according to the original payment deadlines.

11. Audio and Lighting Equipment Lasers

The PHOTOGRAPHER will not photograph or record video while laser lighting effects are in operation.

High-powered entertainment lasers can permanently damage camera sensors; therefore, photography and videography will be temporarily suspended whenever such lasers are active.
